Fourth Annual Take a Kid Fishing Rodeo®

RULES, RELEASE AND INDEMNITY AGREEMENT
1.
PARTICIPATION:
Only adults who register for the Rodeo and either receive an
entry receipt or are listed on the Rodeo’s list of eligible
participants are eligible to participate in the adult categories.
Children under 16 are eligible to participate in the Rodeo
without separate registration provided that their fish are caught while
fishing with an eligible adult participant.
All participants and fish must comply with the rules and
regulations of the State of Louisiana governing the recreational harvest
of saltwater fish in 2001. Any participant who has previously been disqualified in any
Take A Kid Fishing Rodeo shall be ineligible to participate in this
Rodeo.
2.
DATE and TIMES:
The Rodeo will begin at safe light on Saturday, May 18, 2002 and
end at 2:30 p.m. on the same day. Only
fish caught during this period will be eligible.
3.
FISHING METHOD:
All fish entered into competition for prizes must have been
caught and landed by the participant on rod, hook and line exclusively.
4.
TOURNAMENT BOUNDARIES:
The boundaries of the Rodeo are the territorial waters of the State of
Louisiana, including Louisiana’s common boundary waters with Texas and
Mississippi as defined by Louisiana law and the extension of Louisiana
borders seaward 200 miles. Fish
taken outside Rodeo boundaries, from private impoundments or other
waters not legally accessible to the general public, will not be
eligible for entry.
5.
ENTERING FISH:
All winning fish (except the children’s redfish with the most
spots) shall be determined by weight.
Only weights indicated by the graduations on the official Rodeo
scale will be accepted. Visual
fractionalizing of these graduations is not allowed.
Any weights that fall between two graduations on the scale must
be rounded to the lower of the two.
In the event of a tie, the fish that was weighed-in first shall
be declared the winner. All
fish must be caught by the participant on whose behalf the fish is
weighed. All fish entered
must be weighed on the official Rodeo scale by the duly appointed
Weigh-master or Assistant Weigh-master during the time established for
the weigh-in. All fish
entered shall be weighed only once, unless in the determination of the
Weigh-master, a second weighing is necessary to obtain an accurate
weight. All fish entered in
the rodeo shall be marked by the Weigh-master or Assistant Weigh-master,
such as by clipping a tail or fin. No fish may be entered more than once. No transfer of fish among Rodeo participants shall be
allowed. The time for
weigh-in shall be from 12:00 a.m. until 2:00 p.m. on the day of the
Rodeo. All fish must be
entered and weighed at the official Rodeo weigh station at or adjacent
to the Breton Sound Marina in Hopedale, LA.
No frozen, spoiled, gutted, altered, or mutilated fish will be
eligible for entry.
6.
PRIZES: In the
Children’s Division (open to children under 16 years of age), prizes
will be awarded for heaviest redfish 27 inches or under (1st,
2nd and 3rd places), heaviest redfish over 27
inches (1st, 2nd and 3rd places),
redfish with the most spots (1st place only), heaviest
speckled trout (1st, 2nd and 3rd
places) and heaviest flounder (1st, 2nd and 3rd
places). In the Adult’s
Division, prizes will be awarded for heaviest redfish (1st, 2nd
and 3rd places), heaviest stringer of up to five (5) speckled
trout (1st, 2nd and 3rd places) and
heaviest flounder (1st, 2nd and 3rd
places). In the Adult’s
Division, special Take-A-Kid Fishing bonuses will be awarded to the
bonus-eligible adults (see definition below) for heaviest redfish (1st,
2nd and 3rd places), heaviest stringer of up to
five (5) speckled trout (1st, 2nd and 3rd
places) and heaviest flounder (1st, 2nd and 3rd
places). “Bonus-eligible
adults” are those adult participants who caught their fish while
fishing with a child and whose is accompanied to the weigh-in by the
child. Adult and child participants shall be eligible to win in only
one regular prize category in this Rodeo and only one Take-A-Kid Fishing
bonus prize category. Participants
will be permitted to enter more than one fish, but must notify the
Weigh-master by 2:15 p.m. as to the prize they wish to claim.
If a participant under 18 years of age wins a prize, his or her
legal guardian over 18 years of age will receive the prize in his/her
behalf.
7.
SPORTSMANSHIP, HONESTY and
INTEGRITY: This Rodeo is intended to promote principles of
sportsmanship, honesty and integrity among the adults and children
participating in the Rodeo. However,
any person, including minors, entering a prize-winning fish or claiming
a prize must agree to take a polygraph test, and each person entering
the Rodeo agrees to submit to a polygraph test administered by a
polygraphist certified by the Louisiana State Polygraph Board.
Any polygraph test required by these rules shall be taken at
time, place and before the certified polygraphist designated by the
Board of Directors of the Friends of Rodnreel, Inc.
Failure to take or to pass the required polygraph test shall
result in disqualification. All
travel expenses for such polygraph examination are to be paid by
entrant. The decision of
the Board of Directors of the Friends of Rodnreel, Inc., in its sole
discretion, shall be final on any and all matters.
In the event of any litigation between a participant and the
Friends of Rodnreel, Inc. and/or any of the other sponsoring entities
that arises out of any aspect whatsoever of the Rodeo, the losing party
in said litigation shall be bound to pay all attorneys fees, expenses of
litigation, court costs and other costs incurred by and relating to the
litigation by the winning party in said litigation.
8.
DISCLAIMER:
The entire responsibility for valid entry and eligibility
rests solely on the participant or, in the case of a minor, on such
participant’s parent or legal guardian.
Each participant is responsible for knowing the rules of the
Rodeo and, by participating in the Rodeo, agrees to comply with and
abide by all rules of the Rodeo.
9.
RELEASE, HOLD HARMLESS AND
INDEMNITY: IN
CONSIDERATION OF BEING ALLOWED TO ENTER THE RODEO, EACH PERSON AGREES AND
CONTRACTS TO RELEASE, INDEMNIFY AND HOLD HARMLESS THE FRIENDS OF RODNREEL,
INC., ITS AGENTS, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, THE
RODEO WEIGH-MASTER AND ASSISTANT WEIGH-MASTER, ALL RODEO SPONSORES AND ALL
THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, EMPLOYEES AND
REPRESENTATIVES, INCLUDING INDEMNITY FOR ANY NEGLIGENT ACTS OR OMISSIONS
OF THE FOREGOING RELEASED AND INDEMNIFIED PARTIES, FROM ANY AND ALL
LIABILITY, CLAIMS, OR DAMAGES ARISING OUT OF OR IN ANY MANNER WHATSOEVER
CONNECTED WITH THE PLANNING, OPERATION OR CONDUCT OF THE RODEO, AND
INCLUDING BUT NOT LIMITED TO CLAIMS FOR PERSONAL INJURY, WRONGFUL DEATH,
SURVIVAL DAMAGES, PROPERTY DAMAGE, OR CLAIMS RELATING IN ANY WAY TO THE
AWARDING OF PRIZES IN THE RODEO. THE
PARENT OR LEGAL GUARDIAN OF ANY MINOR ENTERING IN, REGISTERING FOR OR
FISHING IN THE RODEO DOES FURTHER CONTRACT AND AGREE THAT THIS RELEASE AND
HOLD HARMLESS AGREEMENT SHALL BE BINDING UPON ANY MINOR ENTERING THE
RODEO. AT THE DISCRETION OF
THE BOARD OF DIRECTORS OF THE FRIENDS OF RODNREEL, INC., WINNERS WILL BE
REQUIRED TO EXECUTE AN ADDITIONAL RELEASE, INDEMNITY AND HOLD HARMLESS
UPON RECEIPT OF PRIZE.
10.
ARBITRATION:
ANY CONTROVERSY, CLAIM OR DISPUTE ARISING OUT OF OR IN ANY WAY
RELATING TO THE TOURNAMENT SHALL BE SETTLED BY BINDING ARBITRATION
CONDUCTED IN METAIRIE, JEFFERSON PARISH, LOUISIANA, IN ACCORDANCE WITH THE
COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION.
JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED BY
A COURT OF COMPETENT JURISDICTION IN ACCORDANCE WITH LAW.
SHOULD LITIGATION AND/OR ARBITRATION RESULT BETWEEN A PARTICIPANT
AND FRIENDS OF RODNREEL, INC. AND/OR ANY SPONSORING ENTITY, IT IS AGREED
THAT THE PREVAILING PARTY IN SUCH LITIGATION AND/OR ARBITRATION SHALL BE
ENTITLED TO RECOVER REASONABLE ATTORNEYS FEES AND ALL COSTS FROM THE OTHER
PARTY.
